2011
SALC has tried to support criminal justice reform in Malawi for the last four years. We have managed to work with attorneys and civil society to identify the most pressing issues and have supported cases that test the right to a trial within a reasonable time, the right to bail, and have fought for change to the law allowing juveniles convicted of murder to be sentenced “at the pleasure of the President”.

Pre-Banjul Meeting Report

The Southern Africa Litigation Centre convened a SADC NGOs meeting on the 12th of April at the Protea Wanderers Hotel, in Johannesburg. The meeting was attended by 35 NGO representatives from 9 SADC states. The Open Society Initiative for Southern Africa (OSISA) funded the meeting.<

SALC and Another v National Director of Public Prosecutions and Others

This was the first case in South Africa to be brought in terms of the Implementation of the Rome Statute of the International Criminal Court Act 27 of 2002. The matter was heard by Judge Hans Fabricius in the Pretoria High Court in March 2012 and judgment is expected in May 2012.

SALC Undertakes an Advocacy Training Workshop

Following the suspension of the SADC Tribunal’s operations by the SADC Summit of Heads of State and Government in August 2010 and May 2011 the Southern Africa Litigation Centre, International Commission of Jurists and the SADC Lawyers Association formally launched a campaign to save the SADC Tribunal. The campaign has seen the three organisations draft legal opinions, publish press releases and opinion pieces, convene two legal consultation meetings with judges, lawyers, CSO activists and SADC Secretariat legal counsel and meet with a few ministers of justice in the SADC region.

SALC's Statement on Malawi at the African Commission

We would like to convey our condolences to the people of Malawi on the passing of President Bingu Wa Mutharika. In light of the current period of transition we urge the new President Joyce Banda to use the opportunity presented to support democracy and the rule of law and to reverse the culture of impunity that was all too evident under the previous administration. We applaud her recent initiatives, demonstrably underlining that hers will be a different administration – in particular, her decision to appoint a high-level investigation into the death of Malawian student, Robert Chasowa.
