Malawi: Challenging Unreasonable or Excessive Bail

SALC has approached the Chief Justice of Malawi seeking constitutional certification in a case challenging the extortionate and arbitrary level at which bail has been set for two Malawian prisoners. SALC is arguing that given the socio-economic harship facing the most vulnerable in Malawian society, the exorbitant bail amounts to a violation of the two applicants' right to liberty.  

SALC is working with the President of Malawi Law Society, Gift Mwakhwawa and the Centre for Human Rights Educations Advice and Assistance (CHREAA).  

A decision by the Chief Justice on constitutional certification is expected in 2011.
